These Terms of Use (“Terms”) govern your access to and use of the InsaneArt application (“Service”, “Application”) provided by Yevhenii Mahlena (“Developer”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using the Application, you confirm that you have read, understood, and agreed to these Terms, as well as our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use the Service. By accessing or using InsaneArt, you confirm that you meet this age requirement. If you are under 18, you are not permitted to use the Application.

3. Description of the Service

InsaneArt allows users to generate images based on text prompts and apply predefined style presets. The Service is intended for personal, non-commercial use only. We reserve the right to modify, suspend, or discontinue any features of the Service at any time without prior notice.

4. User Content

You are solely responsible for any content generated, uploaded, or shared using the Service. You agree not to use the Service to create, share, or distribute content that:

• Is illegal, harmful, threatening, abusive, defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
• Violates any applicable laws, regulations, or third-party rights.

We may remove content or suspend access to the Service in case of violations.

5. Prohibited Uses

You agree not to:

• Use the Service for commercial purposes without prior written consent.
• Attempt to reverse-engineer, decompile, or tamper with the Service.
• Use automated systems (bots, scripts) to interact with the Application.
• Circumvent any security features or restrictions.

6. Subscriptions and Payment

The Service is offered through subscription plans, which may include free trial periods at our discretion. Current subscription options, pricing, and trial availability are clearly displayed within the Application and on the App Store prior to purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Manage subscriptions via your App Store account settings.

7. Intellectual Property

All rights in the Service, including its design, features, AI models, and branding, belong to the Developer. Generated content is for personal use only. Any commercial use, resale, or redistribution of generated images without written permission is prohibited.

8. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in prohibited activities. You may stop using the Service at any time by deleting the Application from your device.

9. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

10. Use of AI-Generated Content

Some features of InsaneArt, including but not limited to the “Inspire Me” tool and AI-based image generation, use third-party artificial intelligence services to produce content based on user input. By using these features, you acknowledge and agree that:

• The generated content is provided “as is” and may sometimes be inaccurate, inappropriate, or unpredictable.
• You are solely responsible for the use, sharing, and interpretation of any AI-generated output.
• You will not use the AI features to create or distribute harmful, illegal, or offensive material.
• We do not guarantee the originality, accuracy, or fitness of the AI-generated content for any specific purpose.

We may update or disable AI-powered functionality at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Service.

12. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict of law principles.

13. Changes to Terms

We may revise these Terms at any time. Updated Terms will be effective upon posting within the Application. Continued use of the Service after changes indicates acceptance.
